The airlines, hotels, cruises, and other suppliers whose travel or other services are offered are independent third parties and not subsidiaries, affiliates, agents, or employees of Whimsie Luxury Travel, LLC.  Whimsie Luxury Travel LLC is not liable for the acts, errors, omissions, representations, warranties, breaches, or negligence of these suppliers, or any personal injuries, death, property damage, or other damages or expenses resulting therefrom. Whimsie Luxury Travel, LLC has no liability and is unable to make any refund in the event of any delay, cancellation, overbooking, strike, travel restrictions, force majeure, or other causes beyond its direct control. Travel or other services provided by such supplier, vendor, guide, or service provider are subject to availability and blackout dates may be imposed without further notice.  Any applicable supplier, vendor, guide, or service provider may, in its sole discretion impose additional fees, terms, conditions and restrictions to any activity or service, and such additional fees, terms, conditions, and restrictions are subject to change at the sole discretion of the supplier, vendor, guide or service provider.  The terms and conditions of the supplier, vendor, guide or service provider govern the purchased services or product and we urge you to carefully review all terms and conditions, as well as the applicable cancellation and refund terms. For example, airline e-tickets have expiration dates that may vary by airline provider. Furthermore, conditions can change rapidly in a country at any time. Rules or regulations may be imposed by government agencies, states, municipalities or similar bodies related to your travel plans It is your responsibility as the traveler to determine if any such additional laws, regulations, fees, terms conditions and restrictions apply to your travel plans and to check the United States government travel advisories for your intended destination at www.travel.state.gov.

Whimsie Luxury Travel, LLC does not warrant the suitability, safety, or security of any activities, suppliers, vendors, guides or service providers. It is your responsibility to check the safety and suitability of any activity and the credentials and fitness of any supplier, vendor, guide or service provider, and you participate at your own risk. Whimsie Luxury Travel, LLC expressly disclaims any express or implied warranty or any liability in connection with such activities, suppliers, vendors, guides or service providers.

Information about travel services provided by suppliers, vendors, guides or service providers is based upon information obtained from the relevant supplier, vendor, guide or service provider. Therefore, Whimsie Luxury Travel, LLC cannot accept responsibility for and shall have no liability for any inaccurate, incomplete or misleading information provided concerning such travel services. In the event that any information provided by Whimsie Luxury Travel, LLC or any suppliers, vendors, guides or service providers is incorrect, Whimsie Luxury Travel, LLC shall have the right to correct such information without incurring any liability to you.

FORCE MAJEURE:

If Whimsie Luxury Travel, LLC or any supplier, vendor, guide or service provider should be prevented, hindered, or delayed in the performance of any obligations hereunder, including, but not limited to providing accommodations or other travel services, due to a “Force Majeure” beyond its reasonable control, then such party shall be excused from further performance.  The term “Force Majeure” as used in these Terms and Conditions, shall mean and refer to (i) an act of God or public enemy, fire, explosion, perils of the sea, lightning, earthquake, storm, flood, declared or undeclared war, revolution,  insurrection, riot, act or piracy, act of terrorism, sabotage, blockade, embargo, accident, pandemic, endemic, or quarantine; (ii) action by a governmental authority which prevents or delays performance of such party’s obligations; or (iii) a strike, lockout or other labor unrest resulting from any cause and whether or not the demands of the employees involved are reasonable or within such party’s power to concede. Notwithstanding Whimsie Luxury Travel, LLC’s or any supplier’s, vendor’s, guide’s or service provider’s inability to perform any obligation hereunder, your obligations hereunder shall continue.

PERSONAL INFORMATION:

Whimsie Luxury Travel, LLC collects certain personally identifiable information, such as your first and last name, valid email address, phone number (collectively, “Personal Information”) and any special requests regarding your stay. We will also collect and send to our third-party payment processor your valid credit card information, which includes your credit card number, expiration date, zip code and CVC number (collectively, “Payment Information”). Our collection of your Personal Information and Payment Information is stored in compliance with our Privacy Policy. Any Personal Information and Payment Information collected, maintained, processed, and/or stored by our third-party payment processor is subject to and governed by its separate and distinct privacy policy. By providing us with your Personal Information and Payment Information, you acknowledge and agree that we will use your Personal Information and Payment Information to book a travel accommodation for you.
